Affluence Terms of Service
Last updated: October 6, 2026
These Terms include a binding individual arbitration agreement and class action waiver (Section 11), which you may opt out of within 30 days. Please also read our Privacy Policy.
1. Introduction and Acceptance
Affluence is a creator platform owned and operated by Affluence Exchange, Inc., a Delaware corporation ("Company," "we," "us," "our"). Creators use Affluence to take part in brand campaigns, track the commissions they earn, and receive payouts. Affluence is available as a website and as mobile apps (together, the "Service").
By creating an account or using the Service, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, do not use the Service. If you use the Service on behalf of an entity, you represent that you have authority to bind it.
2. Eligibility
You must be at least 18 and located in the United States to use the Service. You represent that you are not barred from using it under applicable law and are not located in a comprehensively sanctioned region or on a denied-party list.
3. Your Account
You can sign in with an emailed verification code, Google, or Apple. You must provide accurate information, keep your profile current, safeguard access to your sign-in email and devices, and promptly tell us about unauthorized use. You are responsible for activity under your account.
Social handles you add to your profile help identify you. They are self-reported and do not by themselves verify ownership, grant campaign membership, or entitle you to earnings.
4. Campaigns
Brands and agencies on Affluence may invite you to campaigns, and you may apply to campaigns, exchange messages with brands, request product samples, sign campaign agreements, and submit content. Brands decide whether to accept applications and submissions.
Each campaign has its own terms, which you accept before taking part and which control over these Terms for that campaign to the extent of any conflict. Those terms describe compensation, deliverables, and how the brand may use content you submit, including as ads run through partnership permissions you grant.
5. Commissions and Payouts
Campaigns may pay flat fees, commissions, or performance-based amounts as stated in the campaign terms you accept. The Service shows commissions as they are recorded; amounts can be accruing or settling before they become available for payout, and may be adjusted for errors, refunds, chargebacks, or fraud as described in the campaign terms.
Payouts and identity verification are provided by Whop, whose terms also apply. You may need to complete identity verification and provide tax and payout details before you can withdraw. Whop shows any eligibility requirements, destination, and fees before you submit a withdrawal. You are responsible for taxes on amounts you receive.
No campaign is a promise of income, deals, placement, or results.
6. Acceptable Use
You agree not to:
- misrepresent your identity or affiliation, or impersonate any person;
- submit content you do not have the rights to, or that is unlawful, infringing, deceptive, or harmful;
- manipulate campaign results or commissions, including through fake accounts, self-referrals, or artificial activity;
- scrape, copy, or extract data from the Service except through functionality we provide;
- reverse engineer the Service or circumvent security, rate limits, or access controls;
- use the Service in violation of law or of the rules of any platform you publish on, including endorsement and disclosure rules; or
- interfere with or overburden the Service.
We may investigate suspected violations and remove content, withhold commissions obtained through abuse, and suspend or terminate accounts.
7. Content and Intellectual Property
You keep ownership of content you submit, subject to the rights you grant brands under campaign terms. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit your content as needed to operate the Service and deliver it to the brands you work with.
The Service and our materials are owned by the Company and its licensors. We grant you a limited, revocable, non-transferable license to use the Service for your own creator activity. "Affluence" and related marks may not be used without our permission. If you send us feedback, we may use it without restriction or compensation.
8. Third-Party Services
The Service integrates third-party services such as Whop, Google, Apple, TikTok, Instagram, and Meta. Your use of them is governed by their terms. We are not responsible for their availability or actions. Affluence is not affiliated with or endorsed by TikTok, ByteDance, Meta, or Instagram.
9. Termination
You may stop using the Service at any time and request account deletion in the app under Account → Delete account, as described in our Privacy Policy. We may suspend or terminate access for violation of these Terms or to protect the Service. Amounts already earned under campaign terms are handled as those terms and applicable law require. Sections that by their nature should survive termination will survive.
10. Disclaimers, Liability, and Indemnity
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY RESULT WILL BE ACHIEVED.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, OR DATA. OUR TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS ($100) AND THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM. This limitation does not apply to amounts actually owed but unpaid to you under campaign terms you have accepted. Some jurisdictions do not allow these limitations, so parts may not apply to you.
You will indemnify the Company against claims arising from your content, your use of the Service, or your violation of these Terms, applicable law, or third-party rights.
11. Disputes and Governing Law
Before starting arbitration, send written notice to [email protected] describing the dispute, and we will both negotiate in good faith for at least 30 days.
Except for small-claims matters and requests for injunctive relief to protect intellectual property or account security, disputes arising from the Service or these Terms will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Miami-Dade County, Florida. The Federal Arbitration Act governs this Section. YOU AND THE COMPANY MAY BRING CLAIMS ONLY IN AN INDIVIDUAL CAPACITY, NOT AS PART OF ANY CLASS OR REPRESENTATIVE PROCEEDING.
You may opt out of arbitration by emailing [email protected] with the subject "ARBITRATION OPT-OUT", your name, and your account email within 30 days of first accepting these Terms.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Subject to arbitration, the state and federal courts in Miami-Dade County, Florida have exclusive jurisdiction.
12. Changes, General Terms, and Contact
We may update these Terms. We will post the updated version with a new "Last updated" date and give reasonable notice of material changes in the Service or by email. Continuing to use the Service after the effective date means you accept the updated Terms.
These Terms, the Privacy Policy, and any campaign terms are the entire agreement between you and us about the Service. If a provision is unenforceable, the rest remains in effect. You may not assign these Terms; we may assign them to an affiliate or successor.
